User Terms and Conditions - Please READ this BEFORE ACCESSING the CGateway (“CG”), Online System. By ACCESSING the CGateway® Online System, you agree to be BOUND by the terms and conditions set below. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT USE THE CGateway SYSTEM. ALSO, YOU MAY NOT USE THIS SYSTEM IF YOU DO NOT BELIEVE THAT JESUS CHRIST IS THE SON OF THE MOST HIGH GOD, AND DO NOT BELIEVE IN COMPLETE OBEDIENCE TO JESUS CHRIST TEACHINGS.

These Terms of Use Statement covers the web site CGateway Systems (CGs), managed by the CGateway Company (CGc). Please read these terms carefully before using this web site.

1. By accessing and using the CGateway site (by creating or using a username and the associated password to access this site), you accept these terms and agree to be subjected to the terms and conditions described in this document. If you do not agree to these terms of use, please select cancel to exit this site. The CGateway, reserves the right to update the Terms of Use Statement at any time without prior notice to you, so please check this document periodically for changes. In addition, you will be subjected to any additional posted guidelines or rules applicable to any service, which may be revised from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms of Use.
   

2. If you provide any information that is untrue, inaccurate, not current, or incomplete, or CGateway or its employees, agents, and contractors have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, CGateway or its employees, agents, and contractors have the right to suspend and refuse any and all of your current or future use of the Site. You, not CGateway or its employees, agents, and contractors, are solely responsible for all content (i.e., information, data text or any other information) you upload, post, email or otherwise transmit.

3. Eligibility for use of and access to this CGateway site is subject to final approval and acceptance by CGateway company.

4. All Users must properly register with this site, obtain a personal username, and create a unique password. All information provided must be true, accurate, current, and complete. By registering with this CGateway site, you hereby certify that you are in compliance with all applicable laws and regulations. This includes complying with the following security requirements:

   • Passwords and User/CG IDs are not to be disclosed.

   • You are fully responsible for maintaining the confidentiality of your password. You are fully responsible for all activities that occur under your username/password, or your account.

   • You agree to immediately notify CGateway of any unauthorized use of your username/password, or account or any other breach of security of which you are aware.

   • You agree to properly sign out (logoff) of your account at the end of each session.

   • Antivirus software must be installed and set to run automatically on all computers used to access this CGateway site. All CGateway Users must maintain subscriptions with an antivirus software vendor to keep antivirus current. Users are responsible for performing full scans of their systems on a regular basis to eliminate any virus contamination. If a User is unable to disinfect their system for any reason, that system is not to be utilized to access CGateway System until it is virus-free. Please contact your antivirus software vendor for instruction. Should a virus be instituted into the CGateway system by a User, that User will be contacted immediately by CGateway representative. The User's CG account will be suspended until such time as the User can prove its systems are virus-free and the CG system is analyzed by both the CGateway systems administrators and security personnel to determine the extent of any related damages.

   • CGateway ASSUMES NO LIABILITY FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THESE REQUIREMENTS.

5. CGateway has the right, without limitation, to suspend or terminate any account and to refuse any and all current or future use of the site or any portion thereof.

6. To protect your account and yourself of sensitive information being lost or damage, all Users must properly exit the system by correctly signing out.

7. Users are advised that an automatic inactivity logout of their username account will take place after 30 minutes of inactivity in the system.

8. CGateway will not release nor use your stored information for purposes other than those associated with the User requested services and update information due to such Users.

9. Use of the CGateway system does not constitute compliance with the law. Users operating the CGateway system are responsible for ensuring compliance.

10. CGateway assumes no responsibility for the timeliness, deletion, failed or untimely delivery, or failure to store any User information or communications.

11. CGateway MAKES NO REPRESENTATIONS, WARRANTIES, OR ASSURANCES AS TO THE AVAILABILITY OF THE SITE.

12. CGateway reserves the right to modify, suspend, or discontinue, temporarily or permanently, the site (or any part thereof) for any reason and without notice. CGateway is not liable for any damages that may be caused by any modification, suspension, or discontinuance of this site. The information and materials herein are subject to change.

13. The services provided through CGateway system are confidential for use solely as directed and authorized by the Users that requested for these services.

14. NO PRIVATE RIGHT CREATED: This site is provided by CGateway for the convenience of users that need this type of service rendered to them. It does not confer nor create any rights or privileges for any person or party.

15. DISCLAIMER: NEITHER CGATEWAY, NOR ANY OF ITS SUBSIDIARIES, SHALL BE LIABLE FOR ERRORS, DELAYS, OR INTERRUPTIONS IN PROVIDING THIS SERVICE, ERRORS IN JUDGMENT, OR ANY OF THEIR OWN ACTS OR OMISSIONS, INCLUDING THEIR OWN NEGLIGENT ACTS OR OMISSIONS. CGATEWAY AND ITS SUBSIDIARIES SHALL HAVE NO RESPONSIBILITY FOR AND HEREBY EXPRESSLY DISCLAIM ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IN CONNECTION WITH THE PROVISION OF THIS SERVICE HEREUNDER. FURTHER, USER ACKNOWLEDGES AND AGREES IT HAS A DUTY TO AND SHALL REVIEW AND VERIFY THE ACCURACY AND CORRECTNESS OF ALL INFORMATION PRIOR TO USE, SUBMISSION OR TRANSMISSION.

16. LIMITATION OF LIABILITY: IN NO EVENT WILL CGATEWAY OR ITS SUBSIDIARIES BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES, ARISING OUT OF THE PROVISION OR THE ATTEMPT TO PROVIDE SERVICES HEREUNDER IN EXCESS OF THE AMOUNT PAID BY USER, OR THE PARTY ON WHOSE BEHALF USER IS ACTING, FOR THE SERVICE RELATED TO THE DAMAGE. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO DAMAGE TO PROPERTY OR PERSONS CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL OR WANTON MISCONDUCT OF CGATEWAY. THE SOLE LIABILITY OF CGATEWAY AND ITS SUBSIDIARIES, AND THE EXCLUSIVE REMEDY FOR ANY INJURY OR DAMAGE ARISING OUT OF THE ACQUISITION OF THIS SERVICE PROVIDED BY CGATEWAY OR ITS SUBSIDIARIES SHALL BE THE REMEDY SPECIFIED HEREIN.

17. RELEASE: USER AND THE PARTY ON WHOSE BEHALF USER IS ACTING RELEASE AND COVENANT NOT TO SUE CGATEWAY, AND ITS SUBSIDIARIES.
